Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User") and APEX Sports Analytics ("APEX", "we", "us", "our"), governing your access to and use of the website at apexsport.ai and the web application at app.apexsport.ai (collectively, the "Service"). By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.

APEX is a sports analytics platform that provides: Real-time odds data aggregated from third-party sources across 130+ bookmakers and exchanges. Mathematical models and statistical analysis, including Kelly criterion sizing and expected value calculations. AI-powered analysis and insights on individual opportunities. Portfolio tracking and performance monitoring tools. APEX is an information and analytics service. We do not operate as a bookmaker, exchange, or gambling platform. We do not accept, place, or facilitate bets or wagers. We do not handle, hold, or process betting funds. All betting or wagering activity occurs exclusively on third-party platforms that are independent of APEX.

To use the Service, you must: Be at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is higher). Have the legal capacity to enter into a binding agreement. Not be prohibited from using the Service under the laws of your jurisdiction. You are solely responsible for ensuring that your use of the Service, and any actions you take based on information provided by the Service, comply with all laws, regulations, and rules applicable in your jurisdiction. This includes, but is not limited to, gambling laws, tax obligations, and any licensing requirements. APEX makes no representation that the Service is appropriate or available for use in any particular jurisdiction.

You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. One account per person. Sharing accounts, reselling access, or creating multiple accounts to circumvent limitations is prohibited. Notify us immediately at support@apexsport.ai if you believe your account has been compromised.

Access to certain features requires a paid subscription. By subscribing, you agree to the following: Billing: You will be charged at the beginning of each billing period (monthly or annual, as selected). All amounts are in USD unless otherwise stated. Auto-renewal: Subscriptions renew automatically. You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period. Refunds: We do not offer refunds for partial billing periods. If you believe you have been charged in error, contact support@apexsport.ai within 14 days. Price changes: We may change subscription prices with at least 30 days' advance notice. Continued use after a price change constitutes acceptance. Payment processing: Payments are processed by Stripe. We do not store your payment card details. Stripe's terms and privacy policy apply to payment processing.

You agree not to: Use the Service for any unlawful purpose or in violation of applicable laws. Attempt to reverse-engineer, decompile, or extract source code from the Service. Scrape, crawl, or automated-access the Service beyond normal use. Redistribute, resell, or sublicense access to the Service or its data. Interfere with the Service's infrastructure, security, or other users' access. Use the Service to develop a competing product or service. Misrepresent your identity or impersonate another person. We reserve the right to suspend or terminate accounts that violate these rules without refund.

The Service, including its design, code, AI models, algorithms, and content, is owned by APEX Sports Analytics and protected by intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial analytical purposes. Odds data displayed in the Service is sourced from third-party providers and belongs to its respective owners. APEX does not claim ownership of third-party odds data.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that: The Service will be uninterrupted, error-free, or free of harmful components. Odds data will be accurate, complete, or current. Data is sourced from third parties and may contain errors, delays, or omissions. AI analysis, confidence scores, Kelly sizing, or any other calculations will be accurate or result in profit. The Service will meet your particular requirements. APEX is not a financial adviser. Nothing in the Service constitutes financial advice, investment advice, or a recommendation to engage in any betting or wagering activity. You make all decisions at your own risk and discretion.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: APEX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of funds wagered or invested, or other intangible losses arising from your use of or inability to use the Service. Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to APEX in the 12 months preceding the claim. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the maximum extent permitted by law.

You agree to indemnify, defend, and hold harmless APEX, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from: Your use of the Service. Your violation of these Terms. Your violation of any law or regulation. Any betting, wagering, or financial activity you undertake based on information obtained through the Service.

The Service integrates with or displays data from third-party platforms (bookmakers, exchanges, payment processors). APEX is not responsible for the availability, accuracy, or policies of third-party services. Your use of third-party platforms is governed by their respective terms of service and privacy policies. We recommend reviewing them independently.

You may close your account at any time from your account settings or by contacting support@apexsport.ai. We may suspend or terminate your account at any time, with or without notice, for: Violation of these Terms. Suspected fraudulent or abusive activity. Non-payment of subscription fees. Any reason at our discretion. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination (liability, indemnification, intellectual property, dispute resolution) will continue to apply.

We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and, where appropriate, by email. The "Last updated" date at the top indicates the most recent revision. Continued use of the Service after changes constitutes acceptance. If you disagree with the updated Terms, stop using the Service and close your account.

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any dispute arising from these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of England and Wales. Nothing in this section limits your right to bring a claim in your local courts if required by applicable consumer protection law.

APEX provides analytical tools and information. If you choose to engage in sports betting or wagering: Only use funds you can afford to lose. Be aware of the risks. Past data and mathematical models do not guarantee future outcomes. If you or someone you know has a gambling problem, seek help. If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
